POLICIES AND PROCEDURES
PAYMENT:
50% deposit of total charges due at the time of booking. Final payment is due 30 days prior to arrival and will auto charge on your credit card on file.. All bookings made less than 30 days prior to arrival date require full payment at time of booking. We gladly accept Visa, Master Card, American Express, Discover, and Diners Club. Reservation dates are not secure until required payment is received. Any charge on your credit card will appear as Fayette Springs, Inc.
SAFE AND SOUND PLAN:
The Safe and Sound Plan is in lieu of a Security Deposit. The fee is non-refundable. The Ohiopyle Vacation Rental Safe and Sound Plan covers accidental damages up to $1000 as long as the damage is not willful, wanton or a result of gross negligent behavior. (Excludes damage caused by pets) The Safe and Sound Plan also does not cover extra cleaning, trash removal, stains to the carpet or missing items. Please check the Premises upon your arrival and report any damages found, obvious missing items, or if maintenance or cleaning is needed within one hour of check-in. Failure to report any of these items observed by you within one hour of check-in could result in you being held responsible and your credit card on file will be charged for the cost of such items damaged or missing (and you agree to such charges by signing this Rental Agreement). All of our properties are carefully inspected after each rental by our cleaning staff and property inspectors. Any waivers of damage will be administered by Ohiopyle Vacation Rentals staff at the property. Such staff will have the sole authority to determine the nature and extent of damages, necessary repairs and eligibility for the waiver of liability described herein. The guest covered by this Safe and Sound Plan (the “Covered Guest”) MUST report any damage to the unit or its contents to Ohiopyle Vacation Rentals staff prior to check-out or any otherwise applicable damage waiver for such Covered Guest will be void. The rental manager has ultimate claim administration authority. Conditions of Safe and Sound Plan:
The plan will not cover damage resulting from:
Acts of God
Intentional Acts of Covered Guest
Gross Negligence or willful and wanton conduct
Any cause, if the covered guest does not report the damage to Ohiopyle Vacation Rentals by the time the Covered Guest checks out of the rental home
Normal wear and tear
Damage caused by any pet or other animal brought onto the premises by a covered guest
This plan does not cover loss of use of covered property
Coverage does not apply for damage to any property owned by or brought onto premises by a Covered Guest
Property damage resulting from any motorized vehicle or watercraft operated by a Covered Guest.
Safe and Sound Plan Fee:
$45.00/Stay 1 to 6 Guests
$65.00/Stay 7 to 10 Guests
$85.00/Stay 11 or More Guests
Violation of any condition of the Policies and Procedures voids the Safe and Sound Plan. Only the Covered Guest and its registered guests are covered by the Safe and Sound Plan.
CANCELLATION:
1. Cancellations made more than 30 days prior to arrival date will receive a full refund.*
2. Cancellations made 16-30 days prior to arrival will forfeit half of the total rental fee.*
3. Cancellations made less than 16 days prior to arrival will forfeit their entire rental fee.
4. $40 administration fee will be deducted from any refund.
MAXIMUM OCCUPANCY:
Unit’s maximum occupancy at any time shall not exceed the maximum limit listed on page one, without prior approval from Management. You must be 24 years of age or older to obtain an Ohiopyle Vacation Rentals rental unit. Ohiopyle Vacation Rentals does not rent to high school and/or college student(s) or adult(s) under the age of 24 without their parents reserving the property in the parents’ name(s) and the parents being present at the property during the entire stay. Any violation of these standards will be grounds for eviction without refund. The maximum number of guests for this home is listed on page one of this agreement. An additional charge or $10.00 per person per night for guests exceeding the maximum occupancy listed will be assessed.
CHECK IN – CHECK OUT:
Check in time is 4:00 p.m. Check out time is 10:00 a.m. With the size and complexity of our homes, our housekeepers need every minute of the 10 a.m. to 4 p.m. window to ensure the cleanliness of your vacation home. Please do not interfere with their work or pressure our staff to allow you entry before 4 p.m.
KEYS:
House keys will be in a lock-box on the front door. The combination will be sent to you via email 1-2 days prior to your arrival. Keys must be left in the lock-box when you depart. There will be a $50 fee if keys are not returned to the lockbox.
REFUND:
Our homes are well maintained and very clean, but understand that these are unique and intricate homes, which, just like your own, experience unexpected breakdowns. Tenant shall not be entitled to any compensation due to inoperative appliances or air conditioner. Ohiopyle Vacation Rentals, however, upon being notified of any malfunction, will make every effort to have any such appliance or air conditioner promptly repaired. No refunds will be given for loss of electric or water due to power outage in the area. If your property provides TV service or Internet, no refunds will be given for loss of service. Pools, Hot Tubs, Tennis Courts, Game Rooms and other such amenities are not guaranteed. No refunds will be made if they are inoperable. Please remember refunds will not be given based on the vacation rental not containing certain amenities, i.e. Air Conditioning, Hot Tubs and any other amenities. Every effort has been made to ensure that our descriptions, rates and amenities are accurate. However, we cannot be held responsible for changes made by owners to furnishings, rental rates, and equipment or printing errors. Please remember, air conditioning, hot tubs, TV's, DVD players, porch furniture, grills, docks, recreational games and equipment, and the like are furnished as a courtesy by the owner and are not guaranteed. Refunds will not be given due to breakdown of these or similar items. No Refunds will be made in the event a person is required to vacate the premises because of disruptive conduct or failure to follow our Rental Guidelines and Policies.
SMOKING:
This property is a non-smoking facility. Please refrain from smoking inside the house. If smoking is detected it will result in additional $250 fee.
PETS:
The non refundable pet fee is $50 per pet. This fee does not cover damage, breakage, or extra cleaning caused by the pet. Unauthorized occupancy of pets will result in immediate eviction and loss of all rents and payments. All pets should be leashed at all times. Guest is responsible for cleaning up any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning costs. All pets should be treated with a topical flea and tick repellant prior to arrival. Pet(s) are not to be left unattended for an undue length of time, either indoors or out. Ohiopyle Vacation Rentals assumes no responsibility for illness or injury to pets while on premises. The guest is solely responsible for pet while on the property. Damage caused by pets is not covered by the Safe and Sound Plan.
PARKING:
Parking is restricted to designated parking area. Parking on grass is prohibited.
LINENS/TOWELS:
Sheets and towels are provided for the maximum capacity of the home. Beds will be made up with linens, pillows, a blanket and bedspread. Towels are also included. (1 bath towel and 1 washcloth per person) Beach towels are not provided; please do NOT remove towels from the house. Please be sure all linens stay when you leave.
ITEMS LEFT BEHIND:
Ohiopyle Vacation Rentals is not responsible for items left behind. If personal items are left behind there will be a minimum flat rate fee of $25 for shipping and handling; if requested by the Renter. (Depending upon the item) All unclaimed items after 48 hours shall be considered abandoned.
GRILLS:
Please do not place grills on the decks or inside the home. Grills are stored from November through March and are not guaranteed. Charcoal is not provided for grills. Guest is responsible to bring charcoal if grilling will occur.
WINTER:
Roads are plowed routinely; however, remember that winter recreation is dependent on snowfall and you must be prepared with 4-wheel drive, snow tires and/or chains. Cancellations due to weather are non refundable.
MOTHER NATURE:
Because we are in a rural area, wild animals and people often meet under a variety of circumstances. Most creatures are wary of people and will usually leave an area when encountered. Please be aware of your trash and its abilities to attract four-legged visitors. During the year, some pests including mice and bats move indoors for shelter. If you find any nuisances when you are visiting, please call our office right away. No refunds will be issued due to Mother Nature.
TRASH REMOVAL:
Place all trash outdoors in the cans or dumpster provided.
VISITATION:
Ohiopyle Vacation Rentals, the property owner (“Property Owner”), their agents, service providers and employees, shall have the right to access the premises during vacation rental to make repairs or inspections.
CAUSE FOR EVICTION AND IMMEDIATE FORFEITURE OF RENT:
Includes but is not limited to the following: subletting or assignment of the rental agreement, activity constituting a nuisance of which is offensive or disruptive, exceeding the occupancy limit, bringing a pet without written permission, destruction of property, misrepresentation of your group and any illegal use of property.
TENANT AGENCY RELATIONSHIP:
Both parties agree that no landlord/tenant relationship is established by this agreement and it is merely an agreement to occupy.
OUTDOOR FIRES:
Outdoor fires are not permitted on property unless there is a designated fire pit.
ACCIDENTS TO TENANT:
Tenant hereby agrees to hold and save harmless and indemnify Ohiopyle Vacation Rentals and the Property Owner of and from damage or injuries to person or property by reason of any cause whatsoever either in or about the premises or elsewhere.
HOLIDAYS:
The following holidays require a 3-night minimum stay with us: Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, New Years Eve, Martin Luther King Jr. Day and Presidents Day. Holiday rates are the same as the weekend rates.
CLEANING:
Upon leaving the unit, you are responsible for removing all trash from unit to designated can/toter/dumpster, clean and put away all dirty dishes, remove food from refrigerator, close and lock all windows and doors, return all furniture to original location, remove bedding and place beside beds, place all towels and wash clothes in bathtub, report all damages to Ohiopyle Vacation Rentals, turn heat back to 55 degrees in winter and air conditioning off in the summer, and return key to lock box. I agree to leave the property in good order.
INDEMNIFICATION AND HOLD HARMLESS:
I/ We shall be solely responsible for any and all property damage, accident or injury to any person, property or other loss of whatever nature sustained by any person or property arising out of or in any way related to or occurring during My/Our use of the property or equipment located on property. I/We, for ourselves, our heirs, successors and assigns, hereby agree(s) to release, indemnify, and hold harmless Ohiopyle Vacation Rentals, the Property Owner and/or Property Manager, their affiliates, parents, agents, employees, contractors, heirs, successors and assigns of and from and against any and all claims and liability for injury to the person or property of Myself/Ourselves or to any relatives, guest, invitees of the property resulting from any cause whatsoever.
